2 Availability.
2.1 Libellule Patisserie reserves the right to modify the assortment on the website at any time. In this case, the products you have already chosen may become unavailable. This does not apply to products that have already been paid for with bank confirmation.
2.2 Libellule Patisserie also reserves the right to limit special offers, sales, or promotions.
2.3 Our product and price offers are valid as long as they are visible on the website, within the limits of available ingredient stocks. Upon receipt of your order, we check availability. In case of unavailability, a message is sent to you by email, and the refund is processed within 48 hours.
3 Price, Product, and Special Offers.
3.1 Price
All selling prices are final in the online shop. The product price includes all taxes, packaging fees, charges, and all taxes. Payment for additional services not included in the product is excluded. Delivery is also subject to additional charges. Libellule Patisserie Sàrl reserves the right to modify the prices of products and services on the website at any time. The price indicated at the time of ordering with payment confirmation remains unchanged.
3.2 Product
The final product image may differ from that presented on the website in terms of hue, texture, and decoration style due to craftsmanship, which cannot be achieved with 100% similarity. Libellule Patisserie Sàrl reserves the right to modify the shades and arrangement of elements on pastry products while preserving the overall design and color palette.
3.3 Special Offers
Special offers, sales, or discounts are valid only until the specified date or for a specific period and with a specific design. It is possible that auctioned products may be limited beyond our production capacity.
4 Product Guarantee and Safety.
4.1 General Guarantee
Libellule Patisserie guarantees to the customer that the products are manufactured and packaged according to strict sanitary standards. However, if the customer does not follow the storage rules and consumes the product after the expiration date, Libellule Patisserie cannot extend its warranty in this situation. Fresh pastries must be stored at a temperature not exceeding 7 degrees Celsius.
4.2 Post-Delivery Guarantee
The warranty on the appearance of products no longer applies once they have been visually accepted by the customer. Libellule Patisserie Sàrl disclaims any responsibility for damages to pastries once they have exited our control.
4.3. Shipping Guarantee
The warranty on shipped "cookies" products does not apply to how our product will reach you. This product is out of our control after shipment. The shelf life is 2 weeks from the date of receipt of the product as indicated on the carrier's delivery note.
4.4 Safety
It is the customer's responsibility to take care of all aspects of storage and use of the product according to its intended purpose. Familiarize yourself with safety rules regarding decorations on pastry products, on/in which elements such as toothpicks, wooden skewers, florist wire, support structures may be found. It is strictly prohibited to dunking people's faces into our cakes!
4.5 Allergens
Libellule Patisserie cannot be held responsible for any allergic reactions. While our cakes do not contain certain allergens, they are prepared in a kitchen where they are used. It is the customer's responsibility to check the allergen list and inform their guests of potential risks.
5 Delivery and Shipping of Products.
5.1 Local Delivery
After payment confirmation and delivery request, you will receive a notification within 6 to 12 hours via the communication channel you provided to confirm the possibility of delivery. Additional delivery charges apply. The delivery address must be easily accessible. Otherwise, the customer may incur additional charges related to these inconveniences. Libellule Patisserie Sàrl reserves the right to refuse delivery for unforeseen reasons. Delivery takes place from 8:00 am to 6:00 pm.
5.2 Shipping
Long-distance shipping is available only for products in the "cookies" section. Shipping is carried out by DHL or Swiss Post. The shipping cost is a fixed price for parcels based on the delivery address and parcel weight established by the carrier. Please note: we are not responsible for the full preservation of the item during shipping.
6 Customer Commitments.
6.1 Libellule Patisserie undertakes to transmit the messages requested by the customer without modifying them, even at the orthographic level. The customer must verify the requested text when placing the order. The allowed characters for text customization are as follows: ABCDEFGHIJKLMNOPQRSTUVWXYZ#% 1234567890.,’?!+-=@€$&★♥︎
6.2 Visual/logo customizations are uploaded by the customer, who must verify the uploaded document when placing the order.
6.3 The customer is required to immediately check the delivered goods to ensure their completeness and absence of any potential damage due to transportation. In case of such defects, the customer must inform Libellule Patisserie Sàrl of any defects or issues upon discovery using the provided contact number or QR code coordinates on all packaging of our products. It is also necessary to take photos of the damages occurred during the transportation of the goods by our company or partner and send the photos of such damages to the provided contact numbers. In this case, we can mutually agree on partial compensation for the damages. If the customer wishes to obtain full compensation, they must keep the product in the condition it was delivered and cannot use it to obtain compensation. Within 24 hours, we will retrieve the damaged product.
6.4. Resale of products is strictly prohibited unless agreed upon by both parties through a contract and may be subject to legal action.
6.5. It is the customer's responsibility to take care of all aspects of conservation and use of the product according to its intended purpose.
7 Payment Method and Security.
7.1 Online payment is made via Postfinance card, credit cards such as Mastercard and VISA, as well as Twint payments are managed and processed by our partner WorldLine and its Saferpay interface. Payment will be confirmed by email, confirming the order status "Payment made via Saferpay". The customer agrees to use a card personally belonging to them.
7.2 On our site, all prices are indicated in Swiss francs and will be debited in Swiss francs, regardless of your outgoing currency. Cash is possible only in-store. When paying online by credit card or other instant payment methods, the amount is debited at the time of the order for an amount corresponding to 100% of the product price. In case of prepayment, the full payment must be made 1 day before the project realization.
7.3 Late payment: If the customer does not settle their payment obligations in full or in part, all unpaid amounts due to Libellule Patisserie Sàrl for any purchase become immediately due within 7 calendar days following the first payment reminder. The second and third reminders are charged administrative fees of 5 and 10 CHF respectively. In case of failure of reminders, the charged amount may be passed on to a debt collection agency.
8 Order Modification or Cancellation.
8.1 Modifications to orders are permitted up to 7 days before the scheduled delivery for personalized cakes, and up to 6 days before delivery for online orders. Please note that Libellule SARL reserves the right to charge additional fees for modifications, as well as for the loss of value of the ordered products.
8.2 The possibility of modifying an order in the "cookies" section is discussed individually by official email but no less than 9 days before the shipping date.
8.3 Online payment cancellation up to 12 days: An order placed via the website can be fully refunded, but no less than 12 days before the scheduled delivery date. You must inform us by official email. Please note that it will take us one day to process your request. In your email, please provide all necessary information, including the order number, name, address, phone number, payment receipt, and an explanation of your refund request.
8.4 In case of online order cancellation less than 12 days before the delivery date: if the order was paid via the Libellulegateau.ch website, Libellule Patisserie SARL will issue a certificate equal in value to the amount paid, which you can use for a future purchase. To do this, please send an official email to our address, providing all necessary information, including the order number, name, address, phone number, and expressly requesting the issuance of a certificate.
8.5 In case of order cancellation within 70 hours before the delivery date, your payment is non-refundable.
8.6 Orders, payments, and prepayments in the personalized cakes section are officially discussed only via correspondence through the official email address.
9 Protection of Personal Data.
Libellule Patisserie reserves the right to collect and process personal information from its customers. This data is necessary for processing customer orders as well as for improving the services and information provided by the company to its customers. Personal data is limited to the first name, last name, phone number, mobile number, customer number, email address, billing address, shipping address, and, if applicable, for users who have submitted an application, their CV with or without a photo and letters of motivation. The customer has the right to access, correct, and object to their personal data directly on the website. Personal data is not used for other purposes or transmitted to third parties, neither free of charge nor for payment. The company has taken measures to protect access to personal data and ensure the security and confidentiality of this data. However, the company draws users' attention to potential risks in terms of data privacy when transmitted via the Internet. The user must contribute to ensuring this protection by keeping their credentials and passwords confidential to avoid any risk of unauthorized access to their account and personal data.
